Public offer for the provision of rental services for electric bicycles, ATVs, mopeds and motorcycles, as well as other equipment within the framework of tourist tours indicated on the website electrobikes.kz 1. General provisions 1.1. This document (hereinafter referred to as the Offer) is a public offer of private entrepreneur (IP) Dombay (electrobikes.kz) (hereinafter referred to as the Contractor) and is addressed to any individual (hereinafter referred to as the Customer), a user of rental services for electric bicycles, ATVs, mopeds and motorcycles, as well as other equipment including (but not limited to) drones, video cameras and other equipment received within the framework of tourist tours presented on the website electrobikes.kz (hereinafter referred to as the Site) at the places of physical provision of rental services, including (but not limited to) the Ayusay visit center (Kokshoky St. 1, A), the Charyn visit center (Charyn Canyon), Turgen, the Altyn Emel National Park. 1.2. In accordance with Article 395 of the Civil Code of the Republic of Kazakhstan, this Offer is an offer by the Contractor to conclude an agreement for the provision of rental services for the equipment listed in this agreement on the terms and conditions set out below. 1.3. The Customer's full and unconditional acceptance of this Offer is the implementation of the following actions - receiving rental services for electric bicycles and other equipment, in particular, booking an electric bicycle and other equipment specified on the Site, paying for services and receiving the equipment specified on the Site for rent. 1.4. The Contractor reserves the right to make changes to this Offer, which shall come into force from the moment of their publication on the Site. 2. Subject of the Agreement 2.1. The Contractor undertakes to provide the Customer with an electric bicycle, ATV, moped and motorcycle for rent, as well as other equipment (including but not limited to) drones, video cameras, helmets, and other equipment within the framework of tourist tours specified on the electrobikes.kz website under the conditions stipulated by this Offer, and the Customer undertakes to accept and pay for the services. 2.2. The characteristics of electric bicycles, ATVs, mopeds and motorcycles, as well as other equipment available for rent, as well as the cost of services and rental conditions are indicated on the Website. 3. Rights and obligations of the parties 3.1. The Contractor is obliged to: * Provide the Customer with a serviceable electric bicycle, ATV, moped and motorcycle, as well as other tourist and other equipment within the framework of tourist tours specified on the electrobikes.kz website in accordance with the selected rental conditions. * Provide consulting support on the use of electric bicycles, ATVs, mopeds and motorcycles, as well as other equipment within the framework of tourist tours indicated on the website electrobikes.kz. 3.2. The Contractor has the right to: * Refuse to provide services to the Customer who is in a state of alcoholic or drug intoxication or if insufficient skills in using the equipment offered for rent are detected. If the lack of necessary skills is detected on the day of rental, in this case the paid rental fee for the electric bicycle and other equipment will not be returned to the Customer. * Collect from the Customer the cost of repair or replacement of the electric bicycle, ATVs, mopeds and motorcycles, as well as tourist tours indicated on the website electrobikes.kz in the event of damage due to the fault of the Customer. * Change the rental conditions, having previously notified the Customer. 3.3. The Customer is obliged to: * Have the skills in using the equipment offered for rent and indicated on the website. * Comply with traffic rules and the rules for using electric bicycles, ATVs, mopeds and motorcycles, as well as other equipment within the framework of tourist tours indicated on the website electrobikes.kz. * Return the rented equipment within the specified period and in good working order similar to when receiving this equipment for rent. * Pay for rental services in accordance with the selected terms. * Do not transfer the rented equipment to third parties. * From the moment of receiving an electric bicycle, ATV, moped and motorcycle for rent, as well as other equipment within the framework of tourist tours indicated on the website electrobikes.kz, the Customer thereby confirms that he has sufficient skills and knowledge for its driving, use and releases the Contractor, its Employees, partners and employees of visitor centers from legal and other liability in the event of a fall, injury or any injury, death of him or his children, relatives who used the rental services of electric bicycles and other equipment received for rent. Also, all responsibility for the consequences that arose for third parties as a result of accidents, injuries when using a rented electric bicycle and other equipment is the responsibility of the Customer from the moment of receiving the rented equipment and equipment for use. *agrees to return the bicycle, ATV, moped and motorcycle as well as other equipment received during the tours listed on the electrobikes.kz website in a clean, undamaged condition to avoid additional costs for repairs, maintenance or replacement. Undamaged condition means that normal wear and tear is allowed, but does not include broken spokes, torn chains, bent rims, damaged frames, seats, grips, monitors, handlebars, gear shifters, or other parts due to improper use and/or accidents. Damaged or lost parts or components during the rental will be repaired/replaced at the discretion of electrobikes.kz, and the buyer agrees to pay normal retail prices for replaced components or lost equipment. 3.4. The customer has the right to: * Receive a working electric bicycle and other equipment. * Receive consulting support. 4. Cost of services and payment procedure 4.1. The cost of renting electric bicycles and other equipment is indicated on the Website. 4.2. Payment for services is made by any payment method, for example, online payment, cash payment. 4.3. In case of early return of the electric bicycle and other rented equipment, the cost of services is not refundable. 4.4. Late return is subject to payment. In case of failure to return the bicycle and other equipment later than 15 minutes after the expiration of the rental time, a full fee of 10,000 (ten thousand tenge) is charged for each overdue hour for each unit of rented equipment. 5. Liability of the parties 5.1. The parties are liable for failure to fulfill or improper fulfillment of their obligations in accordance with the legislation of the Republic of Kazakhstan. 5.2. The Customer is responsible for damage to or loss of the electric bike and other rented equipment and is obliged to compensate for damaged parts or lost equipment according to their market value, including delivery services and work to replace the part. 5.3 The Customer is also responsible for wearing a helmet, fully understanding the consequences in the form of injuries and mutilations in case of not wearing it, undertakes not to use mobile devices (photo, video, phone and others) while driving an electric bike and other rented vehicles and other equipment from IP Dombay (ATV, motorcycle, scooter, other vehicles and rented equipment) 6. Force Majeure 6.1. The parties are released from liability for failure to fulfill or improper fulfillment of their obligations in the event of force majeure. 7. Dispute Resolution 7.1. All disputes and disagreements arising between the parties shall be resolved through negotiations. 7.2. In case of impossibility of dispute resolution by negotiations, they are subject to consideration in court in accordance with the legislation of the Republic of Kazakhstan. 8. Other conditions 8.1. This Offer shall enter into force from the moment of its publication on the Site and shall be valid until its withdrawal by the Contractor. 8.2. In all other respects not provided for by this Offer, the parties shall be guided by the legislation of the Republic of Kazakhstan. 9. Lease agreement and rules (this document will be asked to be signed when renting the bikes) I have sufficient skills to operate a bicycle, I am sober, and I am fully aware of the risks of operating an electric bicycle. I hereby acknowledge and agree to the following terms and conditions of the rental agreement: Electric bicycles of IP Dombay (Electrobikes.kz) are rented clean and in proper working order and must be returned in the same way. It is the customer's responsibility to ensure they understand the bike's driving limitations, range display and riding within the appropriate mechanical speed and electric motor range. Helmets are included in the rental price and must be worn at all times while riding your rental e-bike. I agree not to use mobile phone, camera or other electronic equipment and other devices which may distract me from driving and thus cause accidental fall and injury. Electrobikes.kz bicycles are maintained in serviceable condition; however, it is the customer's responsibility to check the bike before riding. The customer accepts the use of the equipment as is and assumes full responsibility for the care of the equipment while it is in his/her possession. Customer agrees to return the bike in a clean, undamaged condition to avoid additional costs for repair, maintenance or replacement. This condition means normal wear and tear is acceptable but does not include broken spokes, rims, bent rims, damaged frames, monitors, handlebars, seats or other parts due to misuse and/or accidents. Damaged parts or components will be repaired/replaced at the discretion of electrobikes.kz and the buyer agrees to pay regular retail prices for the replaced components and repair works. Hourly and daily rentals must be returned 15 minutes before the end of the rental. Late returns are subject to a fee 10 000 (ten thousand) tenge for each hour. If the bike is not returned, the replacement bike will be charged in full at the current MSRP. Assumption of Risk: I understand and accept that renting this e-bike(s) and participating in cycling exposes me/my child to many dangers which may involve an imminent risk of death, injury (including but not limited to serious spinal or head injury ) and loss or damage to property. I also understand that I/my child must be in good physical condition to participate in cycling, and I confirm that I/my child does not have any underlying health conditions that would prevent me/my child from participating in cycling . I/my child do not have a medical condition and I/my child have not been diagnosed with a condition that prevents cycling. Notwithstanding the foregoing risks and acknowledgments, I hereby assume all risks of injury or death to myself/my child, and loss or damage to property arising from renting this e-bike and participating in bike rides. I understand the inherent risks associated with the use of this rental cycling equipment and accept full responsibility for any such damage or injury that may occur. Waiver and Release: In consideration of Electrobikes.kz (IP Dombay) or its rental agent renting this bicycle to me/my child, I specifically release and forever discharge them, officers, agents and employees from any liability or claims for injury, illness, clash with other cars or vehicels on the roads, causing death, injury, loss or property damage that I/my child may suffer while renting and participating in this e-bike(s). This release includes, but is not limited to, liability or claims for injury, illness, death or damage caused by the negligence of Electrobikes.kz or its affiliates, officers, agents or employees. Subject to the Waiver and Indemnification Agreement, I intend to indemnify and hold Electrobikes.kz harmless from any liability for any such property loss or damage, personal injury or death caused by Electrobikes.kz's negligence or based on breach of contract, breach of warranties or any other legal theory. By renting the equipment from electrobikes.kz I confirm that I fully understand that in the event of injury, illness, death or damage to me/my child while renting this e-bike or participating in cycling, I will have no right to make a claim or file a complaint. legal action against Electrobikes.kz or its affiliates, officers, agents or employees, even if they or any of them negligently caused caused me/my child injury, illness, death or damage. I understand the importance of wearing a helmet. The helmet must be worn at all times. I understand, that this action may result in serious injury, including, but not limited to, injury spine or head. I understand that this action may involve danger, associated with other bicycles, traffic or road conditions. The Electrobikes.kz rental agent answered all my questions.
